Just trying to figure something out and getting only so far with my search.
My aunt died several years ago and naturally her husband inherited her share of their property. They didn't have children. My uncle (as he was to us) seems to want to leave us nephews a share but is not the type to get around to creating a will.
My question is, is my mother considered his sister (in law) by the laws of intestacy? It seems unfair that his nephews on that side will inherit the property when our grandparents helped fund the purchase of the property. I'm just unsure if "in law" counts or if it's just blood relative. I suspect it is just blood relative which seems unfair but I suppose if he were to make a will to split the estate it wouldn't be an issue.
There must be a simple answer?
(both his and my aunts parents have passed and he has a surviving sister and two nephews on that side and three on my deceased aunts side - me and my brothers).
Thanks!
