would you be able to help me with some information regarding buying a house?
We found a house that we like and it is in our price range. We submitted an offer which was accepted.
During the conveyance process, we found out that:
- the house is registered to a person who is deceased
- the person had 2 kids and during the lifetime, a deed was signed that gave the 2 kids half of the house. This was never registered with Registers of Scotland
- the deceased person had a will that deals with 1/2 of the property as the other half was donated to the kids. The executors are dealing with this.
- the executors and the kids are part in the sale
In the conveyancing procedure, we asked for the title to be amended, so the 2 kids will be added for their 1/2 part of the house. Apparently, this might not be possible as the person on the title is deceased.
Would it be possible to help me out with some advice on what should we do or how should we proceed? Would it be still safe to go ahead or start to look somewhere else?
