    Is the claim just for the amount £117.60? Did you get a list of overdue invoice charges in addition?

      Why are they issuing court claims from way back in April along with fresh people like me that did it in January? there is something very wrong here with this company. It feels like they are making a last ditch attempt to make money off their scam before they get shut down. We need to get that list together of all the people who have suddenly been issued the CC claims so we can use them in our defence's. Amethyst does it have to be a scanned copy as my printer is broke or can I email images of the N1 off an ipad like I did with their fake claim form?

        It may well be the case that they're issuing claims like confetti in an attempt to make hay while the sun shines although issuing court claims in batches could be their standard modus operandi if the default judgments listed on their site are anything to go by.

        Either way issues like this shouldn't really be included in either your defence or witness statement.

        Defences should be restricted to the legal reasons why you dispute the claim and the specific legislation you intend to rely on. Witness statements are your account of the facts relating to issues arising from your dispute with the claimant. Opinions and conjecture should really be kept out of it.

                  I am new to this site and have just finished reading all the posts in this thread, unfortuately my husband is also caught up in this mess.We applied for a passport appointment last September through what we thought was the offical passport site, 2 days later we go to the Peterbourgh passport office and after going through security we was asked for our name for the appointment and guess what we was not on the list. We spoke to a supervisor who expained that we had been scammed but agreed to see us as we had mentioned that we were running back and forwards to the hospital everyday to visit our son who was on a 2 week course of IV's.

                  About a month later we opened a dispute with the credit card company explaining that the so called company had not made a appointment for my husband on the given date that we was given to attend the passport office, the credit card company got no response and repaid our money back, all was quite for a little while then suddenly out of the blue the phone starts ringing and no-one answers, then a text appears on the mobile phone. About a month later my husband gets issued with a claim form from the county court dated 5/2/2015 which he has sent a acknowledgment of service. He has now obviously got to get an defence together to fight this.

                  Any help with be greatly appreciated.

                    Sorry to hear you and your husband have been caught up in this. As you can see you aren't alone, and peeps on here will help all they can.

                    Is it now just over six months since your appointment would have been ? The HMPO only seem to keep records for six months but you could give them a call and ask them if then can send you some sort of confirmation that no appointment was booked. It would help with the defence, but don't worry it isn't imperative.

                    Also after doing the dispute with your credit card, did you receive any threatening letters from BPS ( about calling the police and accusing you of fraud ??) .

I found a small reference to the terms and conditions, apparently when you sign you opt out of the 14 day cooling off period, which I couldn't find on their terms and conditions at the time when I filled the form out. When were you first charged? It seems like they wait a long time so we might have all forgotten and destroyed all evidence.

                        I was getting calls and texts from them at all hours - Saturday nights at 12 midnight, all different unsociable hours, each time I blocked their number and they kept using a different number, I think now I have blocked all numbers in the company and I do not answer any withheld numbers and I had to take off my answer phone as I was being left messages. I have another e-mail address as the one they have I have 100 of junk mail as I think they must have given my address to any and everyone.

                        These sites must be shut down, it's not fair !

                              Amethyst when you say sorting out an individual thread for each person defence is that once we are in court or do we have to write our defence first possibly giving plenty of time for the company to find an argument against each of our point? I am worried that I will get all emotional and confused in court and they can turn things against me... Sorry for all the questions

                                We have to acknowledge the claim first, then write a defence and submit that, within 33days of the date on the claim form.

                                The BPS have 28 days to respond to say if they want to continue (they will), and you'll get a allocation questionnaire to move the claim to your local court.

                                Once it is there the judge then sends out directions and possibly a hearing date. We put together your witness statement and evidence and put that in a few weeks before the court date ( and BPS have to send you theirs too) - and that's all before we get to any court date.

                                There is nothing they can turn against you honestly xxx and by the time you reach court a few others case will have been heard and won (or lost) and we'll know exactly what we're dealing with.
