For reference ( ACTUAL CLAIM )

Particulars of Claim

We provided xxxxxxx with a package which included booking an appointment at the xxxxx passport office for xx xxxxxxxxxx 2014 along with a range of other services.

Our website and contract make it clear that we are not the Passport Office and that they are not paying for the passport fee through our company.

The Defendants contract includes their signature, computers IP address xx.xxx.xx.xxx.x and them stating I have read, understood and agree to your terms. It was also agreed the 14 days cancellation period would be waived. Invoice and Contract at XXXXXX.signedcontract.org.uk/xxxxxxx

The Defendant guaranteed to pay within 72 hours but has failed to pay to date.

We have done all we can to settle the matter without the need of the courts but now see this as the only means of securing money that we are legally entitled to.

Agree Overdue Invoice Charges will continue to be added until the balance is cleared.

I know what is with those sign right here labels... Do you know if I hadn't have found this site I was on the verge of just paying as the paperwork is quite intimidating, I forgot to attach a copy of the contract which they sent with those court claims do you still want to look at that?

I am now feeling their lack of response to me since I found this site is beyond belief, surely they are the ones that should be done for fraud and acting criminally as the CAB have said. The copy of the contract that came sixteen days later was the only time I had it in durable form. I will wait to see what next week brings, if they believe they are acting within the law and provided a legitimate service they should follow through with their threats shouldn't they?

Just to confirm, as I said I would, we do now have a verified genuine court claim (not avidusers - still waiting on that while he's on holiday).

I am waiting for this as I haven't paid so what do i do if I receive a court claim? Should I be worried, give in? I don't want to out of principle but don't need this hanging over my head!

If you (or indeed anyone) receives a court claim from them let us know immediately

We're in the process of getting a formal legal opinion on whether and on what grounds the claims can be defended that we'll be able to share.

Also can anyone describe the 30 minute telephone consultation ? Did they do it ?

Did anyone complete an actual passport application form on their site and have it checked ? What form did you complete to take to the appointment ? etc

From what I understand, my wife had to complete the official form which she got from the PO herself. I can't see why they needed her to give her personal info - certainly, a completed passport form never arrived from BPS. I believe there is also a case for obtaining detailed personal information via misrepresentation.

I would also consider that charging a client for 'being available' is complete and utter BS. "I'll be here from 10.00-10.30 if you need advice. You didn't call? Doesn't matter. That's £10.00, please." I'd love to hear a magistrate/judge's opinion on that one.

Have BPS actually replied to anyone here? They did not acknowledge an email we sent to cancel on the same day the form etc was filled in; they have not returned receipts for emails with letters attached nor replied to those emails.

I would be very interested to see how they could secure judgement in our case considering the trail of errors and inconsistencies to date. It really is disappointing that Trading Standards etc. do not seem to be doing anything to bring this bunch of crooks to justice.
