                Lol not clued up on the new laws and regulations regarding the creation of a binding contract online requiring the payment to be made and declining of a persons card payment is classed as contractual consideration and non acceptance of customers offer - Are they!!

                  This is from the Yates judgment:

                  I have not been shown any evidence from the Claimant as to how the final contract is
                  formed. The law states that it should be by an “obliged to pay” button or some similar
                  unequivocal button, but nothing has been produced to me today. Mr. Howard’s
                  evidence is that the consumer can click the “submit now” button as far as he recalls,
                  but he did not have it in front of him.
                  So not only couldn't the judge figure out at what point Howard was claiming the contract was formed neither, it appears, could Howard himself.

                      Thing is, the sh*t may have hit the fan, but think he'll just get away with a quick scrape on the grass to get rid. Useless. Oh, to add to the pyre of uselessness, the ICO have decided to take no further action on everyone's details (well I found 4600 odd individual contracts by changing one or two letters at the end of a link) being publicly available for over a year,


                      Another issue with this kind of scam which someone has just been victim of, is other people using your name and address/phone number etc to complete the form on the BPS website - for amusement? for revenge? who knows... but there's no ID verification so anyone could fill in anyone elses details and potentially land them with a CCJ for £190 odd.

                                We're all behind you, I know its not the same as standing in there with you, but we will be thinking of you xxxx Out of 772 claims he has bought that we only know for definite that less than 50 people have defended. CAB have had 500 complaints about the company but without you guys on here standing up to Mr Howard and fighting for what is right, on principle and in the interests of justice, he, and others, would be able to carry on in smuggy smugland for goodness only knows how long.

                                Don't forget to ask for your costs at the end of the hearing - only travel and day off work, parking etc but every little helps you out, and hurts his pocket.
