    Yip as your visit to the site and thus contract were before the regs came into force one bit June 13th 2014 and other bit October 2014 we couldn't use them in your case ( which is why they weren't in your WS or Skeleton argument). Pre June 13th the main part is the misrep act and standard contract law (ie no consideration/intention to contract).

    ( and congrats on both counts xxx)

      Yes that's right, I believe that is what she was saying, that the dates meant it wasn't covered on those points of law, informed consent sounds familiar and she did ask was there a terms and conditions box that RH uses in his defense, at the start of the process.

      I said no. I said I filled in the form but left the site when I realised I had made a mistake and his was the NOT the GOV web site.

      I wonder if he forgot about my case and didn't file the right paperwork?

        During my "defense" I brought up the section of distance selling that teaboy2 brought up. She said that wasn't relevant as that law was made after June. I didn't quite understand that but.

        So it's the contract for SURE just not the exact bit.

        Thats all she wrote I am afraid, it was a bit of a blur to be honest, I wasn't prepared very well as my son was born Friday and had a few issues, I literally left court drove to the Hospital and picked him up, brought him home and now I write this.

        And yes they came in to force in June 2014. section 14 is the part relevant to the explicit acknowledgement of need to pay (i.e. click pay button). But the regulations themselves merely enforce basic contract law principles of offer (offer withdrawal), consideration, acceptance of offer (declination of offer) and confirmation of acceptance.

        So those who are effected where they used RH's site prior to june 2014 will have to rely on those principles, alongside other arguments, where as those that used the site on or after June 2014 can use the regulations. But either-way you can use the regulations to substantiate your claim that you never entered an agreement as no offer (i.e. pay button not clicked) was made on the basis that the regulations support the basic contractual formation requirements for a contract to be formed - though only if it were the case you didn't go through with payment.

                  I don't know what to do about this. My relative has changed her telephone number and her mobile number.

                    court papers would go to her physical address, not her telephone.

                    So for now nothing to worry about, but if you do receive court papers let us know here straight away.

                    And email Ame as she suggested so she can help you put a stop to the harassing calls and emails etc.
