          The 'company' (website here http://www.britishpassportsuk.co.uk) has been going since 2007 ... maybe this is where RH got the idea for BPS from
          Debt is like any other trap, easy enough to get into, but hard enough to get out of.

                      He did click the 'pay now' button but his card was declined.

                      Thing is RH argues that you agree to the terms before you reach the pay now stage and that the payment terms are 72 hours.

                        We don't have much detail at the mo .... however this was in his Skeleton argument ... and obviously it was backed up with his Witness Statement filed previously

                        1. The Defendant submits that without being misled into believing the Claimant’s website was the official HMPO he would not have chosen to pay a third party £117.60 to book an otherwise free appointment for him at his local passport office. Rather he would have telephoned the official HMPO himself (as indeed he did after leaving the Claimant’s website) on an 0300 telephone number and booked the appointment himself.


                        1. The Defendant did not enter into a contract with the Claimant.


                        1. No payment was made and therefore there was no consideration which is a pre-requisite to a contract being formed.

                          Ahh yes, i think Avid user actually PM'd me and i did advise him that payment being declined would mean the offer was therefore declined as a result of the payment being declined. Or something along those lines.

                            Hello all

                            Well that's right I "won" the claim against me was dismissed.

                            Admins please feel free to delete some of this if you think it would help RH.

                            So I attended today RH didn't. The judge asked me a few questions, firstly just explain why I was on the site what I thought I was getting from the site. Essentially the first sections of my Witness statement.

                            She asked did the website look like the claimant says it did when you applied, I said no.

                            That was pretty much it.

                            Then I go out wait 10 minutes and come back in. She then read her verdict.

                            The bits I could remember and write down.

                            He had not complied with Part 27 civil procedure rules and that bothered her, she went on that it seemed his entire case seemed very generic.

                            "She said there was no intention to create legal relations and therefore no valid contract"

                            I think in the end how the site looked was less important than contract law.


                            During my "defense" I brought up the section of distance selling that teaboy2 brought up. She said that wasn't relevant as that law was made after June. I didn't quite understand that but.

                            So it's the contract for SURE just not the exact bit.

                            Thats all she wrote I am afraid, it was a bit of a blur to be honest, I wasn't prepared very well as my son was born Friday and had a few issues, I literally left court drove to the Hospital and picked him up, brought him home and now I write this.

                              I wonder which bit of part 27 she was referring to as there's quite a few sections https://www.justice.gov.uk/courts/pr...l/rules/part27

                              I think what she meant by ''no intention to create legal relations and therefore no valid contract'' is that you didn't give your informed consent to enter into any contract.

                              I'm not sure on the distance selling regs and 1 June but [MENTION=6]Amethyst[/MENTION] will know.

                              Anyway you did great and don't feel you have to stick around and answer any more questions from us, go and spend your time with your boy.
