            Excellent news, RebeccaSmith's judgment has been set aside as her defence has a reasonable prospect of success so the CCJ will be removed and we can carry on to defend the case.

            Richard didn't show up - we were a bit iffy whether he would know it was just a set aside or not so we had prepared to defend the full claim just incase he showed up... but that means we're extra prepared for the full hearing when it comes around.

            Costs will be dealt with at the full hearing.

                Does anyone have experience of a setaside and how long it takes for the CCJ to be removed from credit file and register ?

                  CCj must be removed by the losing party notifying the credit agencies, Land registry within a reasonable period of time after. Think most is 30 days for them to be removed.

                    The court officer should tell the Registry Trust pretty quickly. Then normally filters through on the CRA feeds within 2 weeks.

                      Jules just spoke to court to double check - so wait for the order to come through, the court contact the registry trust themselves and it normally takes 10 days but to expect it being done and off CRA files in 14-21 days.

                        Thanks Nibbs, crossed posts while I was getting from horses mouth. But yes you are completely right xxx I thought that's what happened just had a panic with Teaboy saying we had to get Richard to do it... like that would go well lol.

                            Yes i think i've finished i will send next week - the court first and BPS next Wednesday so he will get 14 days before. I should have his 14 days before? If I don't do i tell the court?

                              Yes you should get his 14 days before and if you don't call the court to find out if he's filed it with them.
