  • Work Injury

I had a serious injury at work where I worked as a lorry driver, I was delivering a pallet of copy paper weighing 600kg, I was pulling it up the customers driveway with a manual pallet truck, the truck became stuck and when I tried to pull it my right leg slipped from under me causing my left leg to smash against the the pallet truck resulting in breaking my leg in four places and smashing my ankle.
i am claiming against my employers and and the people I was delivering to, my employers insurers have denied liability and I have heard nothing from the customers insurers so my solicitor issued proceedings against both of them on the 24th April 2024, he has not received defence from either and my solicitor has not applied for default judgment, I don’t understand what his reason is for not doing so, could it be the longer my case goes on the more money he gets.
    Regards

Have you asked your solicitor for an update and what his plan for your case is? If you have not, do that.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf

It's unlikely that your solicitor is intentionally delaying for more money. There may be strategic reasons for not applying for default judgment, such as ongoing settlement negotiations or waiting for more information. It's best to ask your solicitor directly for clarification.
