  • Driver won't give insurance details

    Hi all. Hope for some advice.

    I was in a car accident as a passenger, it was another drivers fault. The driver of the car I was in wont give me any accident details or insurance details. I do have the other drivers reg number though.

    I have now been told by the driver of the car I was in that a deal was done between them not to go through insurance. This I can't believe especially as the Police at the crash said the car is a right off.

    I have tried to use accident injury specialist but they said they require the details, reg number , insurers of the driver of the car I was in otherwise they cant forward the claim.

    Is there anyway I can get the required information ?

        Ah so the answer to the question was that you sustained an injury in the accident and now wish to make a claim via a "personal injury" company. I can understand why the driver does not wish to give his/her insurance details as any claim will affect their no claims bonus (if this was dealt with directly) and the cost of future insurance. I have no idea whether you have a legal right to this information but perhaps someone who does know will comment.

          Surely your solicitors will know how to get all the information they need.

            Thanks for the replies. I haven't spoke to my solicitor yet only the accident claim company. At the moment I am at a loss.

              If you know the registration numbers of the vehicles involved you should be able to get the details you need from MIB (https://www.mib.org.uk/check-insuran...r-an-accident/)

                I'm not sure if that is right?

                AIUI the OP was a passenger in car A which was involved in a collision with car B, the collision apparently being caused by the negligence of the driver of car B.

                The drivers of cars A and B have swapped insurance etc details but they have both agreed not to go through their respective insurers and instead to "sort it out" between themselves.

                The OP has perhaps - or perhaps not - suffered injury and wants to sue somebody, presumably the driver of car B who caused the accident. The driver of car A, the car the OP was in, knows the details of the driver of car B, but refuses to give them to the OP.

                Whether the driver of car A is required to provide the details of the driver of car B to the OP or not, I do not know.

                I would suggest the OP consider the following courses of action:

                (1) if the accident injury specialist the OP has engaged doesn't know how to get the required details by using the registration number of car B that the OP has told them, then the OP should consider binning the "accident injury specialist"; and /or

                (2) contacting the driver of car A and pointing out that if they can't provide to the OP the deatils of the driver of car B, then the OP might have no alternative but to claim against the only driver that they do know (ie the driver of car A); and/or

                (3) assuming car A is some sort of licensed hire car or Uber, complaining to the licensing authority or Uber; and/or

                (4) checking the insurance details of the reg number they have and taking action themselves.

                But I'm not a lawyer and I'm not offering any of the above as legal advice that the OP should follow. Just possible ideas to consider...

                  I only have the reg number of the car that hit us.. I was told by the police the car looks a write off , the driver I was with won't give me any details and is blocking me from further contact. I may go to and try the police with what little info I have but surely there must be a legal way to combat this.

                      Claim against the driver of the car in which he was a passenger. It is then up to that driver to claim if he wishes against the third party driver..

                        Thanks for replies. Yes I was injured and been off work for 2 months with no income because of it.
                        Just to clarify I was in car A , I do not have details of car A . I do have the reg number of car B and I believe its insurer.
                        Accident lawyer company cannot proceed without details of car A , the one I was in.

                          Manxman I don't know if it is right that the driver's insurance will be impacted but I would fear it to be the case and can therefore understand why the driver does not wish to get involved. It is unfair,however, if the OP has been injured. My only question is why was the OP in an unfamiliar car - was it a taxi or uber?
