  • Can we hold solicitor to this figure?

    My daughter and I were involved in a horrific coach crash in Barcelona and I am now permanently disabled.

    We employed a solicitor that specialises in Spanish law. His original letter stated that he valued the claim to be worth between £25 and £50k . However, he has now put a figure to the other side of just £8k.
    My question is can we hold him to the original value of £25k ?

    It's impossible to say from the description you provide. I could provide some impartial advice if you sent over the documents saying ti was worth £25k - £50k and any documents which show it is now worth £8k.

    My initial hunch is that when you first called the company and explained your condition, they told you what it said in the general guidelines for injuries.

    Solicitors shouldn't really tell clients what their injury is worth until they have actual medical evidence - as it causes misunderstandings (which I suspect has happened here).

    Even if a solicitor has valued your medical evidence, then things can come to light the case which may cause your injury to be worth less than expected.

    If a solicitor has accidentally over-valued your case, then your disappointment still does not change the amount your claim is worth and
    you can't just proceed to settle your claim at a higher value than it' worth.

    Raising a complaint will most likely be pointless - however, it's impossible to give better guidance without looking at the correspondence.
