  • Car Finance Voluntary Termination PCP Agreement - advice needed

    Hi [MENTION=71570]R0b[/MENTION],

    I have submitted for voluntary termination for my Dacia Sandero Stepway which is on a PCP type agreement.

    The vehicle is being inspected and collected on Friday (2 days from now), and I have been reading other threads in similar relation.

    The car is being inspected by Manheim and our finance is through RCI Financial Services, whom seem to both be members of BVRLA according to their member directory for March 2017.

    We have had the car professionally valeted, damaged car seat repaired, and scratches touched up, but still visible. Pictures have been taken of all angles, repairs and damages.

    I have also read not to sign any documentation after the inspection, as I am not legally obligated to do so. Is this still the case?

    Are there any other precautions I should take before and during the inspection process?

    Ihave just found your guide to voluntary termination, and have realised I signed a 'Return Slip' which states 'I am exercising my right to voluntary terminate the above Agreement. I understand how any liability amount will be calculated and the process for returning the car has been fully explained to me. I agree that I will settle any charges for collection of the vehicle (where this option has been ticked below), damage, missing items and/or excess mileage charges as invoiced by you'.
    I signed and dated this as they said it was a requirement before we could arrange the inspection and collection.

    Just because you have signed it does not mean you are liable, any agreed terms which contradict your rights under the CCA is void and unenforceable. Lenders cannot exclude any rights your entitled to under the CCA even if you signed the slip. To avoid any hassle in the future, don't sign any documentaiton.
