I am VT'ing an agreement with Private and Commercial Finance - it's HP and I've sent the termination notice, I have had a letter back from them today which states the following:
'“You have the right to end this agreement as set out in the section headed TERMINATION YOUR RIGHTS.You must then at your own expense return the Goods to us at such an address as we reasonably specify,
together with the registration document, keys, road fund licence, service history and test certificate in the case of a motor vehicle. If you have failed to take reasonable care of the Goods you must pay to us on
demand a sum equal to the cost of putting them in a reasonable condition”.'
I believe I actually have no 'legal' obligation to return the vehicle at my cost, I have no problem giving them keys, V5, service history, of course there is no road fund licence the vehicl is SORN right now as I haven't used it for 3months. It currently has no MOT in force (expired back in March) but as it's off the road I don't believe I MUST have one in place either.
I'd like some confirmation of my understanding - as their clause seems at odds with the CCA itself.
