  • Termination of PCP last year

Sorry its another PCP question again.
I made a voluntary termination of a PCP last year and the car was removed at the beginning of September 2015. I did everything I read in the forums including taking photos of the car. I never heard anything until last week. (End August 2016) The finance company VW are asking for £300 payment for refurbishments due to a dented bonnet and 'botched repair'. There was no such thing on the car it was in pristine condition as was mentioned by the person who drove it away.

I do not have the means to pay the amount asked and don't see why I should. I don't thing I have the photos any more, it was a year ago and I have a new phone now.

I have Any help or suggestions of what I can do please?

    Hello,

Just as an afterthought, I would suggest next time to back up your photos. It is always said to keep any evidence regarding a dispute for a minimum of 6 years (that's the limitation period for bringing claims).

Do you have a copy of the report or anything else that may show the car was in a reasonable condition? If not you could still deny this and question why it has taken them just about 12 months to come back to you and state that there is suddenly a dented bonnet and botched repair. That fact that nothing was heard of from them for such a long time and that the person who inspected the car said it was also in good condition made you assume there was no dispute. given the lapse of time, they cannot claim back this amount and have effectively waived their right to do so by their conduct.
If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you

I can't find the original report but I could probably find the photos.
The details were that I actually received a phone call (Don't know how they got my number) from VW finance asking me for money about two weeks ago. When I asked what for I was told it was for the month of September 2015 finance payment. I told the woman on the line that I was fully paid up. She then changed it to me owing extra mileage on the vehicle when it was returned. I then told her that the mileage was well within the amount stated and it changed to 'refurbishment costs.'
I then received a letter and bill for it a couple of days later.

If you can find the photo's then that would probably help your case. Could you perhaps post up the letter with your personal info redacted so I can take a look? You can upload the photo to www.postimage.org then copy and paste the thumbnail link.

You may wish to consider sending VW a Subject Access Request (£10 Cheque) and request a copy of that call recording along with any other information they hold about you. For the call you should specify if possible the time of the call and date for them to trace. Don't explain why you need it just put it in there, If the call was recent and they record calls (most companies do) then they ought to have it but don't expect too much.
