    Hi

    I have had a look on your website and hoping that someone can assist me with an issue which i have with Santander.

    I terminated my car HP agreement in Feb after i made 50% of the payments. The car was collected at my house.

    When the guy inspected the car, he found a very minor scruff on one of the alloy wheels. Something which i hadnt even seen. I did ask him whether he needed to note it - but he insisted.

    Today I have received a notice from Santander requesting me to pay £45. It seemed very short and aggressive the letter but apparently there was a previous letter sent to me highlighting the damage, which i have never received - they are resending.

    I do not think i am liable for this as per the agreement and due to the nature of it then it must surely fall under wear and tear. i feel as though that i have taken reasonable care of the vehicle. It was a 5 year agreement and i terminated after 2 1/2 years.

    I took pictures of the car before handing it back - on the picture of the wheel in full view you cant even see the mark! I can upload them if needed.

    Just wondering what my next steps should be as i dont think from a legal standpoint they can chase this payment.

    I had a car with Santander and VT'd around September last year, £70 collection fees and £45 for a scuffed alloy which was wear and tear. After going through their complaints procedure they insisted that I need to pay and gave me their final decision. Ombudsman contacted them a few days ago and they called me back wihtin 24 hours to say they have written it off "as it is not economical for them to pursue it any further". A letter confirming it should arrive in the next couple of days but apparently they had written it off back in December and failed to inform me!

    Its a annoying but if you contest it and say the car was returned in reasonable condition, you have photographs which prove it was then they'll eventually write it off. You just may have to submit your complaint to the ombudsman to get the end result.

      So its literally a case of sticking to your guns. So just say it was returned in reasonable condition and eventually they should back down?

        Yes it is the only way they could enforce it is by going to court and for £45 its not worth their time.
