  • Vehicle Insurance Liverpool and Victoria

    I had a minor accident and the other party admitted liability. My insurance company Liverpool and Victoria wrote the car off and didn't even bother following through with the third party's insurance company, who I have to admit have been excellent and have agreed to pay for all the damage.

    I have had the car repaired at the expense of the other party, but I looking for compensation from Liverpool and Victoria for me having to handle the claim myself.

    Any ideas on how I can get compensation from Liverpool and Victoria for not fulfilling their duties for which I pay an annual premium.

    When you say L & V "wrote the car off", do you know which Loss Category they stated in their letter to you, A, B, C or D? Also, did L & V give their reasons for writing-off the vehicle in any correspondence with you?

    Just as a matter of interest, who was the third-party insurer?

      I assume you had full comprehensive cover, and LV offered (or were about to offer) a settlement figure.
      Your insurers fulfill their side of the contract by offering you the market value of the vehicle. You will find, if you read your policy , that it is their discretion whether or not to repair the vehicle. They do not have to pursue the third party, but they may if they wish to, at which point you subrogate all your rights to your insurers.
      If you accept their offer of market value the vehicle becomes the property of the insurance company, although sometimes they allow one to retain it.
      A word of warning...some companies do not insure written off vehicles. If the LV are one of these (I don't think they are, but do check your policy) you will no longer be insured.

      The LV have carried out their side of the contract and you have no claim against them. They offered full compensation for your vehicle.

        Can you clarify some things, please?

        1. Did L & V pay you any money after writing-off your vehicle?
        2. The third-party insurers, having paid for repairs, must have decided your vehicle was economically repairable. Is this correct?
        3. Who are the third-party insurers?
        4. How old was your vehicle when it was involved in the incident?
        5. What make and model is it?
