The important change from 1st of October it is the registered keeper becomes responsible BUT it is still a contract so charges have to be reasonable and proportional to expenses. AND NOT a penalty

Absolutely, this is mentioned in the link from the Bailiff Section. It is interesting in a local retail park to see tape now placed over parts of the signs (I have photos of the original sign). As parking there is free, it is difficult to see how they could claim anything at all, despite the changes in legislation as no consequential loss can be proven to have been suffered.

If you look in the Bailiffs' Guide under 'ParkingOffences' which is where people tend to be pointed when they have a problem, you'll see it is already stickied in there. I believe there are people working hard behind the scenes to ensure LB members get the very best and very latest information possible. The legislation regarding this is still only a fortnight old!

@ Bluebottle - What you say is pretty accurate, but for the 'consumer' there are also hoops that should be jumped through to protect themselves. If you haven't already done so, have a read of the link, it's interesting.

Thank you for drawing my attention to that, Labman. I found the article involving South Ayrshire Trading Standards especially interesting, particularly the bit about the PPC being forced to pay back £23,000 to motorists. Respect to South Ayrshire Trading Standards for their determination, persistence and hard work.

One comment I would make where a PPC mentions bye-laws is to challenge them by asking them to quote the legislation from which the bye-laws are drawn. Even where bye-laws are in force, there will always be the original enabling legislation that has given rise to them.

Oh dear, now I am properly confused!! I received a parking charge notice earlier this week for an 'offence' committed on 8th October 2012. I parked in a Morrisons car park for 52 mins over the allotted 3 hours free parking. I honestly thought that the car park was free full stop and did not notice any signage, but to be frank, I wasn't looking! So - is the general consensus that Parking Charges received after 1st October should be paid?? I did a fair bit of research tonight (mostly to stop my husband whittling) and felt very confident to go ahead and ignore the letters...until the last 20 mins when I read the latter pages of this thread- and now I don't know what to do! How can Parking Eye claim for reasonable parking charge losses (I.e £1 per hour) when this particular car park does not charge and no ticket needs to be purchased? Could someone please advise me on what to do- pay or ignore?!?

Ignore. Nothing has changed.

The PPC's think that making the RK liable (under certain circumstances) will suddenly make everyone pay up. Obviously some will, but the PPC will still have to issue a court claim against non-payers, so in that sense the situation is the same as before

It isn't TCP who lurk around your local Morrison's car park, is it? They lurk around one near to where I live, telling motorists they'll be taken to court if they don't pay the Parking Charge Notices they stick on people's cars. They have already had a warning from the local police about misleading motorists as to the law relating to Parking Charge Notices and I would not be surprised if they are heading for another.

Hi all,
Went to blackpool last week end for a few days and parked in what I believed to be a pay and display car park
The car park was not lite and very dark and did not see any signage saying it was a privet car park and paid at a pay and display machine at the top border of the car park.
On arrival home had a letter from parking eye asking for £100 or £60 paid in 14 days
I was in this car park for 20min
This as really stressed me out as I have only my 14yr old daughter to confirm that I paid at the machine.
Any advice please do I pay or Not???????????????
