  • Bmw Car Finance Charging Order

    Hi there,

    A couple of years ago BMW finance appointed Wragge and Co to repossess my BMW that was on finance. Unfortunately I could not return the car to them as I had hired to somebody and he was involved in a accident. I could not get in touch with that person and hence did not know where the car was. However after bitting the bullet I decided to learn an expensive lesson and went to court and BMW got a charging order on my house. Upto this day I am paying £250 per month towards the debt of £37k

    A few days ago I went with a friend who had his car impounded due to improper parking and realised that my very same BMW is in that impound god knows how it got there.

    my question to all of you is that what are my chances of retrieving that car?
    does that car belong to me as BMW have a charging order on the full value?
    what is the best action I should take?

    To summarise...

    You had a car on finance.

    You hired it to someone that you didn't know.

    It had no insurance presumably for that.

    The 'someone that you didn't know' allegedly crashed the car somewhere in the world.

    You didn't know where the 'accident' had occurred and didn't know where the driver was but somehow know of these 'facts'.

    You were not particularly bothered about having your £37,000 car disappear into thin air.

    No Police involvement at all.

    You were quite happy to allow BMW to take you to court and the subject of where the car was never came up.

    You are paying £250pm for a car you 'gave away' for nothing.

    With no documentation or proof of ownership your car was 'repaired' and back on the road and 2 years later you find it in a pound that you were allowed to wander around.

      lol middenmess not looking good is it where do you start complicated is a little word with this one a more detailed post might help

        I did get the police involved but they could not find anything and did not want to pursue it as it was a civil matter. Furthermore the car never got repaired and is still in the same condition as it was then.

        I could not pursue this any further dur to my ill health and hence the reason I thought if I could recover it and sell it or repair it myself now I could lower the debt I have

          Car 'disappeared' for two years and was involved in an accident whilst uninsured and the police were not interested and said it was a civil matter?

          Car is in a pound and no bright spark has looked at the registration plate and traced you as the owner?

          In whose pound is the car?

          In two years you must have had letters about the vehicle from DVLA about not being taxed and probably a fine for not having a SORN?

          Have you still got the documents for the car?

          Are you in the UK?

            if you try to sell it it will show on a HPI check that there is outstanding finance. If it had been reported as stolen then there will be an alert on the HPI check also .

            No one in their right mind would buy it.

            why not tell BMW where they can collect their car and ask them to take any resale value off the balance you owe
