I purchased a used vehicle from a dealer approximately 40 miles away using the description photographs and messages between the dealer. Paying a deposit by bank transfer. Prior to arrival I become aware that the photographs dated to six months ago. I queried this I was assured that the vehicle was in excellent condition, exactly as per the photo , that no new work had been required and the previous owner hardly drove the vehicle as his wife struggled to get into the vehicle. I carried out a vehicle search with showed no problems put a couple of MOTs ago welding had been required. A mot with no adviseries was carried 6 months ago, but as per dealership a further new mot had been carried out and the vehicle passed with no adviseries. On delivery there were a number of problems identified. 2 badly curbed wheels, sunroof inoperative ( both not seen on advert photographs, there was only one key and the first 22 years service history was missing. The dealer agreed to repair a number of the faults but placed great pressure on us to pay the balance as he promised to fix everything and he would be in great trouble with his director.So under pressure we paid the balance again by bank transfer. Later that night the vehicle would not start so I looked up company house to find the name of the director. Only to find the director resigned a couple of months ago and the sales man is registering as the new director. Immediately cancelled the purchase stating CCR (2013) , which was accepted because of the intermittent starting he agreed to collect the vehicle but couldn’t do so until 8th January and would not refund until 14 days post this 22nd January, despite CCR stating a refund has to be made in 14days if the supplier has agreed to collect the goods so a not to use late collection to delay refund! He also admitted being the director and that the dealership is changing ownership prior to my refund being paid but that he promised to honour it
Today a friend who is a specialist in the make of vehicle who helped with problems with a previous purchase, then bought that vehicle off me. Popped round to reassure me that I was probably over reacting by rejecting so soon, He is a Mot inspector. With out any acces to ramps of even tools he stated it should not ha passed its mot an structural corrosion and identified various major faults meaning the vehicle wasn’t safe to drive,,,HELP
The dealer again promised a refund on 22 nd January but would still not pickup the vehicle until 8th January and that the company is changing hands before then
l am sure I am going to get ripped off but what can I do???
