Car is write off , dealer didn't tell me

      This what i was going to send to Nationwide along with the copy of the dealers letter

      Nationwide building Society Visa Dispute

      Dear Sirs,

      I wish to raise a Visa dispute regarding a payment to Four Fab Wheels on 27/09/2027.

      On the 27/09 I took delivery of a White Dacia Logan Estate Registration Number FH15 FNN. The car had been marked category S and allegedly repaired after an inspection. Initially there was some work needed on the horn and the airbag light . These were repaired with both myself and the dealer making contributions to the cost.

      After about a month a more serious fault developed which led to the car becoming un-drivable . The car developed a leak to the main coolant system which on inspection by a reputable mechanic was caused by the repairs not being of a satisfactory nature .





      In outline , the radiator Had been pushed back from its' original position at the time of crash but had not been returned to that position after the called repair. This has left the cowl round the fan touching the coolant pipe which cut into the pipe and caused a leak.

      The pipe itself is an inexpensive item which I have already purchased but there is considerable expense in removing the bumper and realigning the radiator . This action is made more difficult by the fact that the bumper is damaged and has not been replaced properly.

      Fore worrying is the smell of fuel under off side front wheel arch where the degassing canister is missing .

      I wrote to the dealer who rejected my complaint saying that the vehicle was an S rebuild.

      I reminded the dealer that the consumer rights legislation requires a vehicle to be fit for purpose and as of merchantable quality. I have him the opportunity to take the car and make good quality repairs and would have been amenable to a reasonable settlement . My email has been ignored and I feel this leaves me no option but to ask for refund under the visa regulations The car is currently still insured and on my drive a home but is unsafe to be driven without considerable extra expense. I paid £3500 in total in comprising deposit of £300 and the balance of £3200.





      I have heard nothing form the dealer since the 28th October when he rejected my proposals .

      I would be happy to allow collection of the vehicle but cannot afford to return a non running vehicle from Cambridge to London.





      Therefore I would claim a chargeback from the dealer to my account

        The best thing to do is use the letter below, it will give it proper structure, just a case of adding adding all the details above.

          I think you should include the fact you have requested a refund, and also make reference to your rights under Consumer Rights Act 2015.

          Tell them the car is available for collection, and you want a refund.
          I certainly wouldn't want to give that trader a chance to repair it now, as he has shown little respect for you, the customer
