  • Moneybarn, Terminated Agreement, court forms recieved

Hi there to anyone who may be able to help. Around a month ago my agreement was terminated by moneybarn due to missed payments caused by problems I was having with my bank account and forgetting to switch the direct debit to my new bank. Regardless of that I do understand they had to terminate the agreement, however I didn’t know this was the case until a Ceatta employee was at my door taking the car (I’ve paid under 1/3 of the agreement)

I called up MoneyBarn and asked if there was any way I would be able to re start the monthly payments and keep the car, and after some of my own research found I can ask for a suspended return of goods order. A requirement of this was that all arrears must be paid in full, which I did pay last Monday. Then asked for income and expenditure details over the phone and I was told that was all they needed from me and then told a few days later I can collect the car from BCA where it is being held which I’m planning to do this weekend.

Today I received a letter from my local court with a claim form, copy of finance agreement, general form of judgement order, admission form and a defence and counterclaim form.

My question is given that I’ve already provided all the information needed and agreed to continue with payments monthly from the date I paid all arrears, do I need to fill in any of these forms? They are very confusing and not really quite sure what they’re asking from me

Any Help would be massively appreciated, thanks in advance

    Hi
Welcome to LB. Apologies for the delayed response
If you are admitting to the claim in full, you should complete form N9A and send it to the claimant.
No need to file it with the court at this stage
You could contact Moneybarn to check that you were meant to still receive a claim form and do they still require completed N9A
