I am trying to help out a friend whose partner tragically died on the 6th Apr. The deceased took out an HP agreement for a new car on the 30th March, this was signed for online. The vehicle has been delivered and remains on their drive virtually unused. I am aware that there is a cooling off period where the finance can be cancelled, is it best to do this online or at the dealer or to phone?
In the HPcontract there are a couple of references to cooling off cancellation one stating that "you will not be entitled to return the vehicle if you withdraw from the agreement".
When the deceased agreed to this its likely he was not of mentally stable given the circumstances of his death. If it is possible that this can be cancelled and the car returned under cooling off would it save it having to be involved in his estate?
