    Hi

    My partner bought a car through a dealer on 23rd October for £2,000. He paid on his Visa Debit. The car broke down 30th October and we have been writing and phoning and emailing them to ask for them to collect the vehicle but they are refusing to reply to us. Autrotrader has even got involved informing them of our rights to a refund. I understand that I have the small claims route but first of all started to go for the Visa chargeback route and have been gathering evidence to make the claim. But now I have chatted to the DVLA and realised that they haven't even sent the V5 form back to them. There is nothing on the system. We have the new keeper slip. I asked DVLA about ownership but they said they don't deal with that side. They recommended we register the vehicle ourselves (I have taxed and insured it) but I am thinking of I don't own the vehicle and DVLA have no record of the dealership sending the V5 form back then is it mine anyway? In which case ask the bank to give me the money back on the basis that they have taken money from me for a vehicle i don't own?

    Hi Carissue

    Write to your Debit Card issuer, ask to do a Chargeback (time limits apply), make sure you get Proof of Postage.

      You do own the vehicle, and it is a legal requirement that you notify the DVLA if the keeper changes.

      As you now have the vehicle you should change the keepers details, before they issue a penalty notice
      If you don't pay the penalty (£55 but£35 if paid early) you could face a £1000 court fine

      First try and recover through the chargeback system, but if thay doesn't work you might have to initiate a court claim
