totally new to forum, have had a read around but can't quite work out if my PCP agreement allows me to not be liable for excess mileage charges.
Car was on an 8,000 per annum mileage agreement, have VT'd the car, the letter that followed the vehicle being collected stated I owe £539.12 in excess mileage. I have done 26652 miles and total allowance for the whole agreement period was 32000. It was a 48 month agreement and I had the car 32 months (I Think).
The agreement says mileage will be calculated on a daily basis I Quote "If it is necessary to consider at any point other than before the date of your final payment whether your mileage allowance has been exceeded your mileage allowance will be calculated on a daily basis, that is the annual allowance will be divided by 365 (366 in a leap year) and ,multiplied by the number of days the vehicle has been in your possession from the date of this agreement.
In addition to you being liable to pay the excess mileage charges if returning the vehicle rather than paying the final payment at the end of this agreement, if you exercise your right to end this agreement early as referred to under section 7 below, you will become liable to pay excess mileage charges at the point immediately prior to returning the vehicle.
another section states that "If you drive the vehicle for more than the expected total mileage per annum and this results in the vehicle being worth less than we anticipated had you not exceeded the expected total mileage per annum we will incur a loss and you will recompense us at the rate set out in page one of this agreement.
Its all a little confusing, I should add, the car was in excellent condition on return and the driver stated how immaculate it was. The initially added £300 to the notice saying it ws for damages, turns out they said there was no service history, it is stored on the vehicles computer which they and the collections company were informed of, they have agreed via telephone to drop the £300 charge, and I made the final payment that got the agreement to halfway. So just need to argue the mileage issue.
