  • Audi VT - will not accept termination letter

    Morning,

    After reading up on many threads on here I decided to issue a letter based on the template here at Legal Beagles to VT my Audi, date effective immediately. I already my new (not-Audi) car and I'm very happy with it. My agreement had 5 months left on it's 3 year deal and I had reach the VT point, as confirmed verbally with Audi finance.

    I sent the letter on 11th March and I had a reply on the 12th form customer service saying I need to fill out their template and confirm I had read and understood their VT Pack (PDF with charges in for dent, scratches etc.)

    I replied to Audi by email to say that I wasn't prepared to either sign or agree to their VT Pack and I would like to arrange a collection of the car via BCA. As you can image this has just started a back and forth where they say they will not process my VT request until I send them the form and I'm not prepared to do that. I also said that I was cancelling the DD and Insurance (which has now been done) but was advised Audi would still try to take the payments as they consider the agreement 'active'.

    After another phone call today where I was told that the car would not be collected until I complete their paperwork. I repeated asked if they could point me to the part of the CCA 1974 where I need to complete the paperwork, but they just said they didn't know. Audi customer services have logged a complaint against their procedures which I was advise I would get a reply in 5 days but resolution could be up to 8 weeks. I was told that during this time Audi would continue to try to take the monthly payments.

    Luckily the car is parked on my private driveway but I'd like to get it taken away. also I'm well under mileage and it's in very good condition, perfect alloys etc. The is two small dents (from Tesco car parks!) but they don't break the paint so perhaps could be consider 'reasonable'.

    I guess my question is:

    1, Do I hold out for the complaints and see where that goes?
    2, Do I start to think about charging them storage for the vehicle?
    3, Am I anywhere near the TORTS process yet?
    4, Do I consider moving the vehicle onto the public highway (it's not insured)?

    I should mention I have VT'd an Audi previously and it went really smoothly, I used a letter from here and they picked it up a week later, heard nothing else.

    I'm certainly not thinking of signing the paperwork, but I do not want them to mark my credit file as late or defaulted payments. So really seeking your input that I've done the right thing so far and simply hold out to see where it goes.

    Just thought I'd update the situation in case this helps anyone else out.

    Had a called from VWFS today form the Comaplin Handler looking into my formal complaint. After explaining my case and going over all the previous documentation they have agreed to uphold my complaint and have instructed BCA to arrnage a collection apppointment for the car.

    I'm feeling better and glad I held out, heopfully this will result in a successful collection of the car. As others on here have said, you do not need to complete their paperwork and the letter I sent using the template on here was all I needed.

    In fact, I've even been promised a gesture of good will for the way the adviers at Audi Finance communucated to me over the VT!
