  • Rejecting a Vehicle - Final Right to Reject

    I am moving to reject a vehicle using my final right to reject

    I have owned the used car for 3 months and have done just 900 miles in the car.

    The car is a 11 plate vehicle with 54,000 miles on the clock. I paid £6500 in cash for car and warranty.

    I believe I have to some extent some legal knowledge so I have made what I think are valid uses of the Consumer Rights Act but I hope more knowledgeable/experienced people can help and answer questions.

      Sorry I read that it said if you post there people will point you in the right direction of where to post and then I found it and thought it would be better in here instead.

      Thank you for your response on the welcome post, I will get all the dates together and add these in to this post shortly.

        Price? Age? mileage?

        Have they arranged to collect car?

        Have you had it inspected independently and have a written report?

          They are in the process of arranging collection.

          And I haven't had an independent inspection.

            IMO you had the short term right to reject as you first notified the fault 6 days after delivery and the vehicle has never been rendered satisfactory. You would be entitled to a full refund.
            However there may be a problem if it was not a true branch but a franchise operation.

              I did write to them with final right to reject as above as I thought this was the correct path due to the 30 days and I have given them a chance to repair it, that has failed.

              Do you think I should leave it for now until they have collected and inspected the vehicle before expressing the above as regardless they need to inspect the car?

              Or should I write to them and tell them that I want to now pursue it as short term right to reject?

              I guess at this point I am unsure whether to go in all guns blazing or hold back until they have looked at the car and keep it a bit more casual.

                Just hold on for now and see how they react.
                If they are a decent company (and they seem to be if they have accepted responsibility for the closed branch if it is a franchised operation)) they will talk to you and try and come to an amicable agreement, and believe me, that is better than all the delay, stress and cost of the legal route.
                Remember you have right to go legal, but that isn't necessarily the best route

                    Hi des8 I had a phone call yesterday that they have found no faults with the car. I am not sure where this leaves me if say the car has further issues or if the thing really breaks down in a big way as they have rejected my rejection.

                    Friends are suggesting to take the car back and if one of the parts they checked was faulty and the thing does break down I would be in a better position as at the moment it is likely a part is failing rather than has failed.

                      Well if you do decide to keep the car and you are still concerned about it you should consider obtaining an independent engineer's.
                      This would hopefully put your mind at rest, or give you the proof you need to advance your claim.

                        Thanks des8. For future reference, how would I get an independent engineer? Would taking it to another garage be enough?

                        I will see what they checked and see if it needs anything else checked although it sounds like they been quite thorough.
