My brother in law has a high performance car that had its engine rebuilt some 6 months ago. After paying for the work to be done, including rebore, special pistons etc, and after driving the car car for some 500 miles, he noticed smoke coming from the exhaust. He contacted the garage, and was told to keep driving as it was OK.
After about 600 miles or so, after the rebuild there was a misfire and hesitation and more smoke from the exhaust. He contacted me at this stage to give my opinion as I am a fully skilled motor vehicle technician and a member of the Institute of Road Transport Engineers etc.
I, in my opinion, said that I thought the Piston Rings had gone, (which were replaced at the engine rebuild 600 miles ago) and that he should contact the garage that rebuilt the engine.
He did just that, and after a couple of weeks and much encouragement, the garage who did the original engine overhaul, collected the car by trailer and took it to their workshops, which, incidently are about 100 miles from where we live.
They have now had the car just over 4 months, the top compression rings have broken, which is the cause of the problem, and they have agreed to do the work free of charge under their warranty. They have had to order new parts from USA, and as the bore of one cylinder is scored, it will have to be bored out and a liner fitted.
The issue is, they keep stating when the car is going to be ready, but the time keeps dragging on and there does not seem to be any progress. The last time the car was visited was about 2 weeks ago and the engine was still missing from the car, and it is getting to the stage where we are considering removal of the car back to my house and doing the repair job myself to get it back on the road.
The garage we feel are deliberately stalling on this as they have had the car over 4 months now, to repair their faulty workmanship, and now the MOT has run out etc.
What is the legal position with this situation?
