I bought an Approved Used VW on PCP finance in March this year. 6 days later it displayed serious electrical faults. The dealership attempted to fix it, but the faults returned in June. It was discovered that the sunroof is leaking into the car and causing the faults. I allowed them to attempt another repair, but the sunroof is still leaking. They also agreed to rectify some paintwork as a condition of purchase, but have messed it up FOUR times, leaving the car in a worse state than it was when I agreed to buy it. Several other things have gone wrong so, as the car is only 3 years old, I rejected it under the Consumer Rights Act 2015. This was after 5 months of ownership. The car had spent 4 weeks with them in total, and I had traveled over 1000 miles to and from the dealership as they repeatedly failed to carry out agreed works but called me to say it was done.
The problems are this:
- I rely on a car for my daily work travels, so I put in my letter that I require an answer within 14 days, and a refund in a further 14 days. I explained that if there are any delays, I will claim £10 per day for storage of the rejected vehicle and also for the costs of a hire car. The dealer has agreed to reimbursement, but the finance company (VWFS) have ignored my emails and only responded to my rejection letter with a generic 'we'll respond to your complaint in 8 weeks' letter.
- The dealer has now offered a refund, but does not seem to have calculated it properly.
I paid £2750 deposit.
They gave me £200 for a part exchange, which (on their suggestion) they retained to perform an Android Auto upgrade to the car.
I have also paid £1133.80 in finance payments (5 x £226.76)
I have only driven 4,143 miles in the car, which is much less per month than the 20,000pa on my finance agreement works out as
I have caused zero damage to the car
The dealer, however, has only offered a refund of £2,187.02. They have worked it out as a finance settlement, rather than a refund. Their sums are as follows:
Amount paid £14,618 (the total purchase cost including extended warranties)
Finance settlement figure £11,330.98
Refund of original cost - finance settlement figure = £3,287.02
They then deducted 3,143 miles at a huge 35 pence (!!) per mile, which means a reduction of £1,100
Total refund = £2187.02
So, my questions:
1) Can VWFS really just fob me off with a 'we'll respond to your complaint in 8 weeks' letter, when I've formally rejected the car under the Act and given them 14 days?
2) As the problems with the car occurred within 30 days, and have not been resolved, am I entitled to a full refund?
3) If, because I rejected the car after 5 months of ownership, I am not entitled to a full refund as above, what refund should I receive? Have they calculated it correctly or not?
I've paid £4083.80 toward this car so far. Even at their extortionate usage charge of 35ppm , I work out that I am owed at least £2983.80 (deposit + part exchange + finance payments total, less the £1100 for mileage). To make things more difficult, I've never received a copy of my finance agreement.
