  • Hitachi Capital End Of Car Lease Disputes

    Hello, I’m new to the site and I have a question I can’t seem to find the answer any where and it seems straightforward enough . Brief background:*My car came to end of lease. Got collected by Manheim on behalf of hitachi capital finance . I wouldn’t sign that I agreed with his findings . ( a chip smart repair) he said wasn’t good enough I same day ring and complain to hitachi. I state I’m prepared to pay for an independent inspection. Days pass and I find car has been sold . Thus can’t carry out an independent inspection .
    question: when there is a financial dispute on a vehicle by law can the lease company sell that vehicle before the dispute is resolved ? If not where in consumer law or contract law can I find it stated.*

    When you say lease, do you mean hire contract or hire purchase?

    Yes the lease company can sell the car, it belongs to them not you so they can do whatever they please with it. The problem is that you've not said what happened during that phone call and if you have a dispute, it is always best to put it in writing. If Hitachi say that you never complained to them and asked for an independent inspection, how can you prove that other than showing a phone record?

    The BVRLA Code of Conduct says that in the case of a dispute, you should be entitled to have an independent inspection carried out. Because Hitachi failed to give let you do that, you could argue they were in breach and therefore nothing should be owed.

    I suggest you write a complaint to the BVRLA dispute resolution team to that effect. You can find their address on the BVRLA Fair Wear and Tear guide at page 10 on Hitachi's website.
