    Hi guys sent vw financial service a email to vt it from the template asking to pay installments this is the reply I received:

    As far as I wm aware the the car has been vt when i sent email.... It says it can take 4 weeks from the date I sign paperwork what should I reply with something along the lines off the car has already been terminated upon receiving my email. And if they don't collect within the 14days I will cancel insurance, road tax and transfer Ownership back.

    I don't want to sign anything. Or fill more stuff out*

    Thank you for contacting Seat financial services.
    *
    Your current voluntary termination shortfall is £2803.54.
    *
    A voluntary termination can take up to 4 weeks to complete from when we receive the form completed by yourself. Once the form is received we terminate your agreement within 72 working hours, which will cancel your direct debits and from this point it is irreversible. If you do have any shortfall then this will be required to be paid within 14 days.
    *
    Once the agreement has been terminated British Car Auctions (BCA) will be in contact with you within 7 days to arrange an inspection and collection date. On the day of collection they will do the inspection for any excess mileage which will be pro-rated down to the date it is collected and also inspect for any refurbishment charges that fall outside of the BVLRA general wear and tear guide.

    Your expected mileage to date is 25677 miles and your excess charge rate is 5p per mile + VAT.

    Section 99 (2) Consumer Credit Act 1974, explicitly states that “Termination of an agreement under subsection 1 [the right to terminate]*does not affect any liability under the agreement which has accrued before the termination”.

    You are correct in that excess mileage is a fundamental contractual term. You are asked to predict your mileage prior to entering into the contractual arrangement and the finance is calculated taking into account the depreciation of the vehicle based on the mileage you selected.* This is clearly set out in your pre-contractual information, the front page of your agreement and clause 11 of your terms.
    Clause 11 is worded as follows:-
    11.1 If the Vehicle covers more than:
    - the Maximum Annual Mileage in any succeeding period of 12 months starting from*** the making of this Agreement and/or
    - the Maximum Total Mileage;
    you will be liable to pay us the Excess Mileage Charge shown on page 1. That liability will accrue with each mile covered by the Vehicle in excess of those Mileages. You must discharge that liability be paying us on demand.
    11.2 If you have paid Excess Mileage Charges in relation to the Maximum Annual Mileage we will deduct this amount from any Excess Mileage Charges payable in relation to the Maximum Total Mileage.
    11.4 If this Agreement terminates early, we will reduce the Maximum Total Mileage in the proportion which the actual period of hire bears to the period of hire originally agreed. Any Excess Mileage Charge will be recalculated using that reduced Maximum Total Mileage.

    If you still wish to dispute the charge then we will have to log a complaint for you that will be passed to our complaint resolution team and if you are then still unhappy with the outcome you have the right to esculate it further to the Financial Ombudsman Services (FOS).

    If there are any charges you will be invoiced for these around 10 days after collection. The vehicle needs to have a valid tax, MOT and insurance up until the point of collection as you will be fully liable for the vehicle until it is collected.

    Please note: If you do decide to keep the vehicle with the retailer we advise to take photographs of the exterior and interior of the vehicle alongside the odometer reading as you would not be present for the inspection.

    Please be aware that voluntary termination is irreversible and should you choose to proceed there is no option to reinstate your agreement or keep your vehicle.

    If you dont want to complete the paperwork then tell them. You are not legally required to do so.*

    I dont really reply to these type of posts because its bread and butter stuff and if you've read my guide or used my templates then you should know already.

      Have emailed back saying I won't be signing anything and that the car was terminated when they received the email I sent thanks*
