  • Advise on Trader / Finance problem please

    Hi*

Can I please get some advice.*
I purchased a vehicle in January 2019 as a replacement for another faulty vehicle from the same trader and from the day of purchase it had a gearbox fault and couple of others which made it dangerous as well as unsatisfactory.*
Vehicle was purchased with a deposit by Debit Card and rest by finance.*
I contacted the dealer on the day of purchase to inform them of the faults and they advised that it would be repaired as it was under warranty. There was a delay of a few weeks as they had no courtesy vehicle.*
We stupidly allowed the Trader around 10 -12 opportunities to repair the vehicle including 7 or 8 visits to the main dealer and it was still faulty.*
On the last attempt the main dealer estimated a £3000 charge to repair the gearbox which the Trader refused as it was not guaranteed to repair it.*
The Trader first tried to offer £4000 less than I paid for the vehicle to buy it back.*
So I approved the Finance Company in September.*
The Finance Company had the vehicle inspected and agreed it was faulty on purchase. They have refunded my payments and told me I have to return the vehicle to the Trader who will take a usage charge from my deposit , I have disagreed with this.*
Am I liable for usage charges as the vehicle was faulty from purchase and the Trader have had numerous attempts to repair it as I read on another post it still falls within the 30 days of Short Term Rejection.*
The vehicle has done around 5500 miles in the last 12 months but we estimate at least 1500 were done my Trader , Main dealer etc trying to repair vehicle.*
Can the Trader even try to charge me as I believe there contract is with the finance company and not me.*
Does anyone please have any advice ??
