Hi. I have a slightly different question to ask. I was reviewing the hire agreement in particular the Declaration section. Where it says ‘you declare that you: (i) agree to be legally bound by the terms of the agreement as set out in pages 2-3 of this agreement’. Turns out the agreement is actually 5 pages long and the section on excess mileage crosses pages 3&4 with anything of value on page 4. Does this mean that I am not legally bound by pages 4&5 of the agreement? And this would act as a good defence not to pay the mileage costs based on technicality?
