VT Excess mileage demand

Completed VT. last week with minor claim of Ł250 for vehicle condition outwith fair W&T. I rejected claim due to fact vehicle was 3 years old when purchased and scuffs were due to previous owner.
Pro rata excess mileage payment of Ł850 requested although still 2000 miles short of total allowance. Can I legally refuse this demand
Any advice would be appreciated
