  • Please Help! Clutch Replacement, Warranty and My Rights

    Hi All,

I'm hoping you can help me with a scenario that has developed over the last couple of days.

5 months ago I bought an approved-used Jaguar on PCP from a Jaguar dealer. The car supposedly underwent a 250point inspection.
On Sunday the car had an almost total transmission failure and was over-revving without accelerating - a sure sign of a knackered clutch. I drove to Jaguar on Monday for inspection and repairs to be covered under warranty. The basis being that an approved used-car shouldn't experience a complete transmission failure only 5 months after purchase.

Jaguar have subsequently looked at the car and the warranty inspector has deemed that the clutch failure is due to 'wear and tear' which isn't under warranty and that a new clutch and fly wheel will be £2500. Furthermore, they're now saying that they won't put the old, damaged clutch back in. Which leaves me with an undrivable car or a £2500 bill - 5 months after purchase.

My argument is that under CRA2015 that the car must have been faulty or developing a fault when I bought it. The car itself had a number of minor issues (tape left on, number plates not attached correctly etc) that lead me to believe the 250 point inspection wasn't carried out but I didn't really follow anything up on it other than a few emails.

Am I really stuck between an undriveable rock and a £2500 hard place?
