  • Motor Finance Termination

    Hello everyone,

I would like to apologise in advance for this being my first ever post on this forum and it being one with a help request.

    https://legalbeagles.info/forums/for...ter-Templates=

    I sent my car finance company the first letter that you have put up on here and after 2 weeks they sent me a letter back saying that;

1- I needed to sign it
    2- Date of request
3- How I wish to end my motor finance agreement with them (Moneyway)

I then added those into the letter and re-sent it to them and today they basically sent the same one back telling me to call them etc if I needed help getting a proper letter together and I believe that their goal is to get me to ring them so that they can get me hooked in on all the extras that I wouldn't otherwise have to pay for and try to make me sign for things that you guys clearly said not to.

Can someone please advise if I should call them or not? I think that they are trying to prolong this so that I have to keep paying.

I have attached their letter for you.

on the second one I sent for them I highlight the date, signed it with date and also highlighted were it said voluntary termination.

    Thanks all in advance.

    Hi,

Sounds like Moneyway are trying to be awkward and stall for one reason or another. They really shouldn't be making it difficult for you to exercise a right which is very simple to do. You didn't even have to comply with their request in the letter in the first place because the VT letter is sufficiently detailed to explain what exactly you are wanting to do. Also, the Consumer Credit Act does not require you to sign the letter with a wet ink signature, you are only required to give notice in writing and in any event, your name printed at the end of the letter is likely to be deemed as a signature anyway.

There's an example letter I posted up not too long ago with a response to this I'll see if I can track it down.

      Hey Rob,

that would be amazing if you could find it.

it's been stressing me out so much honestly.

I was going to call them in the morning but I will see if I can find the reply that you gave so that I can get this sorted.

My partner thought that they would try and get 1 or 2 more payments out of me and force me to pay for extras etc by denying the receipt of the letter.

I really appreciate your comment and the help.

Let me know if you can find it please.

I will try to see if I can find too.

      thanks again

      John
