  • Going through VT and they're trying to charge me

    I am going down the VT route with my car and the company are claiming that I have passed the 50% pony and am able to buy that I owe money due to a GAP insurance policy. They have now quoted me 3 different prices for this and cannot explain where the figure comes from.
    The templates that you have put for excess mileage and wear and tear are great but I don't know where I stand on this fee.
    Any help would be greatly appreciated!!

      Hello

      Have they quoted you three different figures in writing or is this over the phone?

      Whether or not GAP insurance is payable, depends on the circumstances and what the terms of the agreement says. But for background, I would suggest you read the link below, particularly post #10 where I give an explanation of whether multiple services contained in a single agreement are deemed to be separate agreements or one agreement.

      I think it's a decision you will need to take as to whether you fight the amount or defend it. Alternatively you might wish to offer a reduced amount in full and final settlement (make sure to say full and final settlement) to make it go away.

        Sorry im not sure i follow, youve decided to VT and the company is refusing to allow it because of GAP insurance is that right? can you perhaps let us have a little more info about the case, and what the otherside have actually said etc.

            Hi both!!

            Thank you so much!

            I have decided to VT 3 years in to a 4 year agreement because my situation has changed. The finance company are saying that I can as I am past 50% but that I owe somewhere in the region of £220 to cancel the gap insurance as well as around £138.29 for collection (despite my agreement stating £70)

            Twice I have asked them for a full break down of the figures that make up the alleged amount but they can't give me clear answers. Each time I get a poor explanation and a different amount (not by much, but still!) and this has been done in writing via email.

            R0b having looked at your link it looks like exactly the same situation (GAP was £399 and I have paid 3 years worth of instalments). I was never given a copy of the agreement, (only the new car order form, registration certificate, GAP policy and service plan policy) let alone any terms and conditions.

            I have since obtained a digital copy of the agreement from FCA which makes no mention of the GAP being involved in the final payment and does not have the relevant signed terms and conditions attached. When I disputed the charge FCA sent me copies of Ts&Cs but these were dated August this year not when I took out the agreement and I have never seen anything similar to it.

            I can provide all of this information if needed.
