  • VT with possible road bumps

    First allow me to say how much I appreciate the time and effort forum participants are putting in here. Posts by rob have been on my bookmarks for years now whilst I’ve waited for half my loan to be repaid.

    The issues to my vt are as follows

    1. No v5
    2. Not in my name
    3. Scratch to farside door
    4. Excess mileage +1.5k miles
    5. Missed year two service.

    Regarding 1. I’m ordering replacement v5 this week. the reason for 2. Was I was taking out a mortgage at the time so my friend agreed to take the ageeement out in her name. we called today and asked for change of ownership pack to be sent out.

    Are there any real sticking points here that suggest I won’t have a case and should just pay off negative equity at the end of the term (7 payments left. Around 2.5k in negative equity)

    I'll respond in the same order as the questions asked:

    1. If there is no V5 and was lost whilst in your possession then it would be reasonable for you to replace it at your own cost.

    2. Can you explain what you mean by requesting a change of ownership pack?

    3. Subjective so not enough information based on the vehicle's age and how long you have had it in your possession.

    4. Plenty of information on here about excess mileage, the choice is yours whether you pay or not.

    5. If the rest of the vehicle is in reasonable condition you might be able to argue that on the whole, the car is in a reasonable condition and if there is a genuine mistake i.e completely forgot about it that year then it would be up to the finance company to prove otherwise.

    What I should point out to you is that legally speaking, the contract is between your friend and the finance company. Therefore your friend is going to have to give notice to VT, and if she refuses to pay the excess mileage the finance company will look to her, not you for payment.

    You've not said who the finance company is but if it's BMW then they currently have a habit of issuing late payment markers for non-payment of excess mileage charges, which will have a detrimental effect on her credit file, not yours and may eventually cause a rift between the two of you. I would suggest you sit down and talk it through with her before deciding what to challenge and what to accept.

      Ill order the v5 before going ahead.

      “Change of ownership pack” was language used by the finance company when myself and my friend called to change ownership yesterday - from my understanding they’ll send out some paperwork to the both of us which will change the name on the loan.

      I absoloutly will not take action until I’m sure the loan is in my name.

      Loan is with vauxhall finance. I’ve not seen history on your forums with these guys but in fairness I haven’t searched, just read the most recent threads. Seems like people are having a bit of a nightmare with bmw.

        Vauxhall have declined to change the name citing that the application does not meet their criteria.

        Currently i owe £5.9k - the car will sell for around 4.5k, end of term is in March and I’ll owe 4.9k.

        Any other routes I can peruse at this point? Mileage in excess of 14000 over 4 years.
