VWFS Reasonable Care Charges Help

  • VWFS Reasonable Care Charges Help

    Hi Everyone,

    I have gone through the process of VTing my VW and have just had BCA come to inspect the car.

    They're advising £80 exc VAT worth of damage considered to be below reasonable care.

    A scratch on the front bumper and a scrape on the wheel trim.

    Do I have to pay this?

    I am also over on my agreed mileage which I am willing to contest. If I pay for these damages does it weaken my case if I then refuse to pay for excess mileage?

    The excess mileage charges should be contestable but it does depend on their terms and conditions. It is important to discover whether the excess mileage clauses are written as part of the ongoing contract and you are notified of them (or have been during the contract) or they are written as a charge or penalty. If they are a penalty you will be able to contest them as long as your account was up to date with no arrears at the time when YOU VT'd (not when they acknowledge it.

    I am not a lawyer, I just happen to be going through this with Ford at the moment. There is a very good thread on here about Mercedes Benz VT charges from a lady who won her case. It is well worth a read.

    I am afraid I cannot help you with the reasonable care. I am guessing they would have to prove that the damage had occurred as a result of you not taking care of the car. i.e. curbing and alloy wheel would be careless and therefore they have a point. A small stone chip is not your fault. Most companies have a guide to reasonable care. I would ask VW for a copy of theirs.
