      so yesterday the finance company phoned me to acknowledge my rejection letter. They are blaming the broker for stalling in getting the inspection done and i told them yesterday they have had 4 weeks to book a inspection to which the broker/inspector has not yet even been in touch. According to the finance company the broker is not returning there calls as to where we go from now. any advice as to what to do now?

        Write (email) to the finance company that their problems are not yours and you are about to initiate court proceedings

          what should i say? i dont want to look like i dont know what im talking about lol i should also mention after the first complaint was closed i received a letter from the finance company stating that if i was still dissatisfied i had there 'permission' to go to ombudsman is this something i should be thinking about?

            I personally have little faith in the ombudsman.(others hold contrary opinions)
            It is free, but lengthy and works on the basis of what is fair, not necessarily the letter of the law.
            Decision is binding on the finance house, but not on consumer so if you disagree with Ombudsman's decision you can continue with court.


            Write to them pointing out that CRA 2015 Sec20 (16) requires a refund to be made without undue delay.
            You consider their problems with their broker are not your concern and are not sufficient reason to delay matters, and you will initiate court action without any further reference to them if there is no positive response within 24 hours.

              thanks des8 is it defo CRA 2015 Sec20 (16) as iv just looked at the consumer rights act and its (15) that states a refund should be made without due delay? sorry just checking iv got it right. i will write up an email and send it later today

                  Just be warned that the broker inspection is not an inspection, it's just a box ticking exercise that enables them to put (false) weight behind their decision and to use the word 'inspection' in paperwork and in court if it gets to that point. In my experience the guy turned up with not one tool and didn't even open the bonnet, plus there were innacuracies in his report. It's a farce.

                  On a previous court case (I don't have much look with cars) I paid for a PROPER independant inspection and he went over it like a fine tooth comb, on ramps etc and gave me a list of things wrong with the vehicle (including problems I was unaware of) this inspection probably won me the court case.

                    yeah iv read this before... possibly on a post off you which had me worried about the inspection and them turning up with no tools etc. though they have had 4 weeks now to arrange to come and inspect it and they haven't bothered getting in touch grrr

                        someone please help iv received this back from finance company... the paperwork i have signed is with the finance company


                        Good afternoon,

                        We have again contacted your broker to pursue this and we have been reassured that they will be in contact today to organise the inspection of your vehicle.

                        Please be aware, your agreement is a direct deal with your broker which means the broker is acting as the supplying garage. They have 1 opportunity to have the vehicle inspected and any faults present or developing at point of sale will need to be repaired. This will exclude any serviceable parts.

                        We apologise for the delay though, we will continue to try to resolve this matter as quickly as we can.

                          They taking the mickey ! You rejected within 30 days, they never fixed, they've attempted to repair and therefore there is no option available for one attempt to fix. That is reminiscent of the Sale of Goods Act. Remind them that the option of one attempt to fix is no longer available to them.

                            just tell them to read and understand the CRA 2015.
                            Explain that you do not intend to lecture them on your rights but will be initiating a claim on Monday next 23.07.2018, naming them as defendant as they are owner and supplier of the vehicle.

                              ok so iv took both your advice and replied to their email. i have said i will initiate a claim on mon 30th as iv only just replied today. (i wanted to see if the inspector actually did ring as promised so i could build it into my email which they didnt)
