    I am in the process of cancelling my agreement. I am cancelling the agreement under voluntary termination and I am 31 months in to a 37 month contract with over half of the amount paid. In my contract on the part regarding excess mileage it reads;

    'When you return the goods you should ensure that the mileage travelled does not exceed the agree mileage of XXX within the duration of the contract'

    Now as I am terminating the contract after 31 months is the duration of the contract therefore 31 months and not 37? I am slightly over on my miles and do not mind paying but obviously I would rather pay the smaller amount than have the whole amount pro-rated. This part of the clause is not under the termination heading but under return of goods so I know I could argue it further but really don't think it is worth the hassle so I am prepared to pay (as little as possible).

    I will keep everyone posted with updates as to how the whole process goes. So far I have sent the letter, not returned their forms and e mailed them requesting the car be collected asap.
