  • VT troubles, GDPR failure included.

    VTed a car in December, approx 65% of the way through the agreement. MOTed 4 days before I returned it, serviced a month before.

    Took pictures and took car to their agent (A local dealership) who refused to inspect or sign for the car (Its not their problem apparently they just collect the cars for the finance company). I took pics of the car in the dealership to show it arrived ok. It spent at least one night in their public car park.

    A week later the car arrived at the auction house and was inspected.

    About a month later a hand written report arrived with near £800 of repairs (All scuffs and scrapes.)

    I replied denying liability included printouts of pics of wheels and front/back of car.

    They have so far refused to provide picture proof of damages relying on the handritten report. They asked for closeup dated pics from me showing no damage. (How can I show closeups when they refuse to show me where the damage allegedly is?) I have many dated pics of the car but will not send them all unless neccessary.

    I GDPRed them on the 25th, it arrived today. No mention of damage in any docs other than the same hand written report.

    In their MP3 files of calls included in the GDPR info are about 8 calls for individuals other than me. They include account and address information.

    I also consider the gap and warranty were misold and will be attempting to claim them back. The dealer was offering much better products but they ignored this and signed me up for their products instead.

    The final kicker, the car was an 11 year old zafira, which almost set itself on fire and I had to do without it whilst it was under the recall for a month.

    They are claiming 150 odd in insurance outstanding and 760 in repairs. I'm disputing.

    Can I use their GDPR breach in my favour? I can likely contact the individuals in the calls so could make things very sticky for them. Any tips in contacting them?

    Report the GDPR data protection breaches to the ICO and the company immediately. There isn't anything to be gained by contacting the individuals involved although the ICO should tell the company to inform the customers whose data has been compromised.

    That's pretty speedy response to your GDPR request if you only sent it on the 25th... too speedy really.

    In their letter have they told you where these alleged scuffs and scrapes are - I think you are absolutely right for them to indentify the damage to you before giving them your images ( being cynical they could just then say they were on parts you hadn't got photos of !)

    Did the finance company instruct you to return the car to the dealership ?

      The dealership I returned the car to was their 'agent' no relationship with me other than that. Finance company told me to deliver it to their agent. (It was close to my address)

      Depending on the length, depth and size of the scuffs would depend on whether they were fair wear and tear, they never supplied me with details only scuffs and scrapes exist and their approx location eg line pointing to front right of car diagram.
