No spare key

Hi all

just a little help. I'm returning my motorbike back to Motonovo tomorrow as I've paid half way through my finance agreement and have the right to complete a Voluntary Termination.

However, I'm worried because although the bike is in great condition and I have all the relevant paperwork; I have lost the spare key that came with the motorbike during a house move.

I'm worried that I will be charged for this. Do I have to pay a charge if the company say I have too or legally can I argue that I don't need too as I have paid half of my agreement and the motorbike has been returned in a reasonable condition?

Any advise would be appeciated

Recommendations:

I would personally recommend if you can to post a copy of your finance agreement up on here covering your personal details as that would be helpful for the community to assist.

I would also try your best to try and find the spare key, try retracing your steps and also maybe contacting the residents of your previous address and removal company?

My layman gut feeling which I could be legally wrong and please anyone correct me if I am wrong:

I would say that not returning all the items such as spare key this could be classed a breach and they could take the reasonably belief since the motorbike still belongs to them they should get all the items back including the spare key and since you do not have the spare key they could take the reasonably view that they have suffered a loss in that respect and subsequently charge you not just for replacement key but for all the locks in the motorbike to be changed as this is fundamental security measure of the cars security and have the right to charge you.

That's a fantastic idea, and recommendation, however if I may kindly I would like to further recommend is if you do decide to take Amethyst's superb recommendation is to make sure to use "Genuine Parts" what I mean by that is going into the dealership or an approved automobile locksmith who has the access to genuine key blanks because if they do, then you will be onto winner. Because if you do not use genuine parts such a genuine key blank but a "compatible" or a "replica" one they may reject the key on assessment possibly send the key to the finance company to investigate further and possibly then do as what I previously made comment to re changing the locks and charging you!

But I would do a side by side analysis on the cost of replacement with genuine parts with the cost of fees and charges by the finance company (if they charge that is depending on the T and C of the agreement) because if you get that you will be able to make a much more informed decision.

Hi

I can't upload the picture but in my terms and conditions it states that I need to return it documents relating to the vehicle. Pay any arrears or other sums payable under the agreement and in a good condition. This was the agreement I signed when agreeing to the finance. It is only now I've received a letter two days prior to collection that they have mentioned they want documents ( MOT ect) along with the master key and any spare keys
