HI I would be grateful for some advice. I voluntary terminated a 7 year old quashqai with Northridge Finance. Well over the 50% mark. The car was returned in good condition. 12 months MOT, full SH Brand new tyres etc. The car was collected from the auction company and driven from Liverpool to Leeds. No paperwork was signed for.
5 weeks later I have received a letter requesting compensation for loss as the car was sold for less than CAP value £5100. Sold for £3500. They are claiming compensation for the loss due to the damage - the cost of the repairs of £1125 for a new clutch, flywheel and starter motor. I was not aware of any mechanical faults with the car prior to it being collected.
I did check the auction site and noticed the car was given a lot number straight away. After a couple of weeks the car was not sold and put into the non-runners section. The audio about the car stated it had a clutch or gearbox problem which needs further investigation.
I dispute the car had a fault prior to it being collected. Further it does not appear the work has been carried out given the audio recording and the letter states due to the condition of the car they struggled to achieve market price.
