  • Smart Parking charge whilst shopping at Matalan in Cheltenham

    Hi there,

Hope one of you lovely peeps can advise me on this.

My partner dropped me in the centre of Cheltenham on 15/08/16 and then drove my car to Matalan, parking in the store carpark run by Smart Parking at 14:15. She was then shopping in the store my my 10yo daughter and her friend, buying school uniform whilst the girls spent some birthday money.

I walked to the car park an hour later, to find they were still in the store, so went to sit in the car and wait.

We have a £72.55 Matalan till receipt, timed at 15:36, after which we exited the car park at 15:43.

Whilst I noticed the very small print parking T&Cs, neither my partner or I saw any signs notifying Matalan customers that there was a procedure to follow to avoid a parking charge being levied, so I am shocked and angered to have received a PCN from Smart Parking.

I've written the following response, which I will submit online, but would appreciate some advice as to whether I have said too much or this should suffice.

    "Dear Sir/Madam,

As registered keeper, I am writing to invoke the appeals procedure for the erroneous parking charge that has been levied against my vehicle whilst I was shopping in the Cheltenham Matalan on 15/08/16 – PCNN XXXXXXXXXXXXXXXX
The driver, xxxxxxxxx (my partner), was in Matalan for the entire duration of the visit with my 10yo daughter and her friend, buying school uniform and spending birthday money and we have the Matalan till receipt of £72.55, timed at 15:36, to prove this.

As you can see from my address, I do not live in Cheltenham. Neither my partner or I are aware of any parking restrictions on this car park and neither of us saw evidence of clearly marked signs advising us that parking was chargeable under any circumstances.

Whilst I can completely appreciate the need to control parking so close to the centre of Cheltenham, for non Matalan customers, it is ridiculous to levy a parking fine against a genuine customer of the shop that the car park serves. As such, I request that the charge is overturned.

If, for any reason, you deem the above account insufficient and reject my appeal, please supply a popla code, as I will be taking the matter further.

    Yours,
    "

    Many thanks,

    Chris

Don't give away the drivers id to Smart, period.

Thanks M1! So, after removing the driver's name, the rest of my appeal sounds fine?

Bit wordy for me, and to be honest they'll reject it anyway. I think sometimes my one is recognised and with a copy of the receipt is more likely to result in an outright cancellation. (see link above).
