  • Appeal rejected by Smart Parking. Should I appeal to POPLA?

    Hello, I'm hoping someone can assist me.

    on 15th July 22 I entered a car park and stayed for 73 minutes to enjoy a coffee at Costa Coffee in Linwood, Renfrewshire. I then received a PCN dated 9th August 22 from Smart Parking as I was 13 minutes over the allocated time to stay in the car park. There is a tablet device which is located at the counter and I never entered my car reg in order to extend my stay for free. I returned to the Costa after receiving my PCN and they provided me with the receipt to prove I purchased a coffee and would hope that would be enough for Smart to cancel the PCN and for common sense to prevail. I uploaded my appeal to them along with an explanation that there is an intermittent connection with the tablet which could have had an impact on my car reg not registering (although I did not enter my car reg but smart do not know this). Today I received a letter from smart upholding the PCN and provided me with a POPLA verification code. Can someone please let me know if I should pursue the POPLA route and if anyone has any valuable info or guidance as to what include this would be greatly appreciated, or should I just pay the £60? Many thanks.

    Letters attached. Excuse the mess of them, I was angry and ripped them up but anxiety got the better of me.
