We recently returned from a holiday in Devon, just outside Braunton. One evening my wife and I went out for a meal and on the way back we stopped off at a bar and parked in the car park above.
A week or so after returning I received a penalty notice showing my car entering the car park at 21:48 and leaving at 22:21. I challenged the company and they have rejected my appeal. I have the option now of paying the £60 penalty or taking my appeal to POPLA and if unsuccessful paying £100.
Would anyone have any advice on my appeal to POPLA and what are my chances of getting an overturn?
My main point is, that the car park was not adequately lit and does not make it clear that charges apply (I'm guessing 24 hours as I did not see any signage). We have stayed at the same place for the last 3 years and parked there last year without penalty so I am guessing that this is a new thing. Unfortunately, we don't live near the town, so I am unable to get any photographic evidence.
