Hi I wondered if you are able to help me regarding a smart parking fine I received in Asda Greenhithe (not the car park, the court yard section behind the store) it is a drop off and collection area.
My father stopped in the above-mentioned area a few weeks ago to pick up my elderly great aunt from my flat, which is next door to the Asda store. Whilst she had been round, the lift in my block of flats had broken and so when my father called to say he had arrived, we had to use the stairs (eight flights). My great aunt has impaired mobility (she is a blue badge holder) - she has a stair lift at home and she is also partially sighted. It took us roughly ten minutes to get her to the car.
My father received a fine stating he overstayed the allowed period to wait and so I appealed the fine within the discount period, explaining the situation, I attached an email from the management company for my flats, confirming the lift was reported broken on the day of the parking fine. I explained about my great aunt having reduced mobility and asked if they would consider retracting the PCN. They replied rejecting the appeal, they said that they were upholding the PCN as they allow sufficient time for drop offs and pick ups, to which you overstayed.
I have taken pictures of all signs in this area and not one states the allowed time period.
Do you think I would have a case to appeal with POPLA. Smart Parking explained I could appeal to POPLA but if I do appeal, and lose, then I have to pay the full fine without a discount. I have pictures of the blue badge also.
The appeal text is saved to my home computer and so I don't have access to it right now but I literally just explained the above, that my relative has impaired mobility and eyesight, the lift was out of service and that the car was not left and the engine running at all times.
