  • Smart Parking Charge - help-won

    Hello everyone,

    I hope someone can help me. In September I hired a car to travel to Cornwall for a few days to visit friends. I stopped off at Newquay.

    I parked the car at Asda, picked up a few bits and then took a (long) look round. I got quite lost; I have a disability which can effect memory, especially in unfamiliar locations. I ended up staying 1 hour over the 2 hour time given and I have since received a parking charge notice.

    I appealed the parking charge notice through the Smart Parking website stating exactly as I have here, and sent them proof of my disability. They have rejected my appeal.

    Can anyone help me with a POPLA appeal? Is it likely to succeed? I have already been charged £35 from Enterprise Rentals for handling a PCN on my behalf, and in a few days the Smart Parking charge will increase to £70.

    I have uploaded the 2 letters from Smart Parking.

    Yes.

    Is it likely to succeed?
    Probably.

    I have already been charged £35 from Enterprise Rentals for handling a PCN on my behalf
    What does the rental agreement say about that ?

      Enterprise have said if the fine is quashed they will refund the £35, I need to send them proof.

        Copy of the appeal would help.

        I reckon Enterprise know they're wrong but we'll see what happens.

          The appeal is pretty much what I said in my first post. Not sure I can get a copy as I did it through their website? I was stupid to appeal to their human nature I guess, rather than looking for this sort of help right away.

          It was in Enterprise's T & C's that if they handle any fines there is a £35 admin charge. Same if I got a speeding ticket etc.

            Just trying to figure if you let them know who was driving.

            Difference is, this isn't a fine.

              I cannot say if I stated definitively I was driving, although my appeal did say I was in Newquay. I may have also said I was alone.

              There is no option to read my appeal on their website.

              I see. Perhaps I can ask Enterprise about that. What is this "fine" then?

                I'd leave Enterprise for afters. We can appeal as registered keeper and leave it to them to dispute it.

                          I slipped up because i forgot.

                          The answer is no.

                          I also slipped up because i meant the date of the notice.

                          I must be getting old !!!!

                          Anyway when i get the answer it'll take only minutes to do.

                            The date of my notice is 28/9/2015. The first notice did not count as it was sent to Enterprise rent-a-car, which was on 11/9/2015

                            Smart said in the second notice that the discount period is applicable to the second notice, not the first.
