  • **WON** Civil Enforcement Ltd (again) - private car park

    Hi,

I have read lots of comments on this company but cannot find anything matching my situation. I parked one evening in a car park used many times before (evenings only) that is used by a number of offices. At 19:53 there we no office lights on so parked as I had done many times. I didn't see any signs because I didn't look as they had not been there before (possibly careless I know).

I now have a PCN issued by CEL so am unsure if I can claim that a) this carpark was empty and none of the offices were currently occupied and b) the signs were new and unexpected. There is no "lost fee" that I can quote as the carpark is otherwise free.

This is quite obviously a way for them to make money by people using a carpark that at that time of the day is not used by anyone else.

    Any advice, gratefully received.

    Dear Sirs,

I, as registered keeper, wish to invoke your appeals process. The driver did not see any signs . I note your notice to keeper is fundamentally flawed when compared to PoFA 2012 schedule 4 para 9 in several aspects .

Should you reject my appeal please supply a popla code.

    Yours etc

If popla is need let me know.

    M1

So...I sent the letter...and waited....and then got a reply saying they had cancelled this notice.

Thankyou so much for the help on this, case closed!
