  • Popla appeal - NTK valid? - won

    Hi,

    I received a parking charge (£100 reduced to £60 if paid in 60 days) from UKPC on the date of 20-6-2015. I followed the appeal process and received the following letters dated 20-07-2015 and 08-09-2015. Can any of the letters be considered as NTK? If so on what grounds should I appeal to POPLA?



    My appeal to UKPC mainly focused on the usual points (Dispropotionate sum, non genuine pre-estimate of loss, etc, and the lack of sign which was "I believe that the signs were not seen/are ambiguous and the predominant purpose is to deter so there is no contract to pay this charge, which is a penalty. Also the place where the car was parked looked like an extension of the Clifton road with no road markings that makes it not clear as it whether it's private property or a restricted parking area."

      I'll sort out popla for you. Seems to required for 6/10 ?

      None of those letters are the notice to keeper. It would look similar to http://www.legalbeagles.info/forums/...5&d=1441893932

        And yes I need to a POPLA appeal by 6th Oct, these are the only letters that I got other that the parking sticker that they attached to my windshield, I will scan the same and attach it.

                    That explains entering a popla appeal quite well.

                    You only get one shot so enter everything at once. You may need to convert to pdf, i'm not sure on that.

                    If anyone else needs to use this fine but please only do so in an emergency as we still haven't seen any decisions from the new assessors to see how they judge appeals. Patience is a virtue.

                          Hi M1,

                          In my case the road where I parked looked to be a continuation of Clifton road. There were no road marking to distinguish the area as restrained area.

                          Also, in my ANPR does not play a role, since it was a parking staff who stuck a parking charge on the windshield, also in the newpopla.rtf, there is a mentioning about 'overstay'. Again in my case as per the sign board, it;s a restricted place where no one is supposed to park.

                          So should I remove ANPR and overstay related portions from the appeal.

                            Locus standi should cover the question over the land and signage helps too. I removed ANPR.

                              Probably my last doubt, should I remove the line starting "
                              The Parking Charge of £100 (or £60) which may be demanded of a motorist who overstays by even" since it's not relevant to my case.

                              In my case the charge was 'Parked in a permit area without displaying a valid permit' though the place where I parked looked like an extension to the Clifton road.
